The State Govt. vide Home Department Notification No.60901/D & A Dtd 28.1.2.2007 has vested on the Police Commissioner, Bhubaneswar-Cuttack to exercise & perform the powers & duties of a District Magistrate in respect of the provisions under sections 106 to 124 of Chapter VIII and 129 to 148 of Chapter X of the Code of Criminal Procedure,1973 within the limits of territorial jurisdiction of the Commissionerate as envisaged u/s 58(1) (a) of the Orissa Urban Police Act,2003 (Orissa Act 8 of 2007).
Further in exercise of powers conferred by section 58(1) (b) of the Act,the Additional Police Commissioner, Deputy Police Commissioners, Additional Deputy Police Commissioners and Assistant Police Commissioners of the Commissionerate of twin cities of Bhubaneswar & Cuttack are authorised to exercise & perform the powers & duties of an Executive Magistrate in respect of the provisions under sections 106 to 124 of Chapter VIII and 129 to 148 of Chapter X of the Code of Criminal Procedure,1973.
The Deputy Police Commissioners of Bhubaneswar and Cuttack shall exercise and perform the powers and duties of an Executive Magistrate in respect of Bhubaneswar & Cuttack Urban Police districts respectively under the provisions of the Code, subject to the general control of the Police Commissioner.
In pursuance of the aforesaid Govt. Notification two courts of Executive magistrates were created in Bhubaneswar and Cuttack and became operational w.e.f 10.01.08.
1. Functioning :-
The Courts of Executive Magistrates, Bhubaneswar & Cuttack are dealing with cases pertaining to sections 107,108,109,110,133,144,145,147 of Cr.P.C. The total number of cases instituted and disposed off in these courts during the year 2019, 2020, 2021, 2022, 2023 till 31.12.2024 are as follows :-

3.Court Building :-
The recently constructed building for the Court of Executive Magistrate, Bhubaneswar was inaugurated on 4.3.09 by Dr.Justice B.S.Chauhan, Chief Justice, Orissa High Court in presence of Justice Shri I.M.Qudushi, Justice Shri Bhabani Prasad Ray, Justice Shri Indrajeet Mohanty, Shri Aditya Prasad Padhi, IAS, Principal Secretary, Home Department, Govt. of Orissa, Shri M.M.Praharaj, IPS, D.G. & I.G. of Police, Orissa. Shri B.K.Sharma, IPS, Commissioner of Police, Bhubaneswar-Cuttack and other senior officers of the Police Commissionerate were also present on the occasion.
The Court building for the Court of Executive Magistrate, Cuttack, located in Barabati Stadium Campus, was inaugurated on 20.6.09 by Justice Shri I.M.Qudushi, acting Chief Justice, Orissa High Court in presence of Justice Shri B.P. Das and Sri Manmohan Praharaj, IPS D.G & I.G of Police, Orissa. Shri B.K.Sharma, IPS, Commissioner of Police, Bhubaneswar-Cuttack and other senior officers of the Police Commissionerate were also present on the occasion.
